These Terms of Service ("Terms") apply to your use of essentraperfumes.in (the "Website") and to every order you place with Essentra Perfumes ("Essentra", "we", "us", "our"). By using the Website or placing an order, you agree to these Terms and to our Privacy Policy, Refund Policy, Shipping Policy and Partial Payment Policy, which form part of these Terms. If you do not agree, please do not use the Website.

1. Who we are

Essentra Perfumes is an independent online retailer of perfume decants, based in Kanpur, Uttar Pradesh, India. Our contact details are listed in section 20.

2. What we sell

A decant is a smaller quantity of a fragrance transferred from a full-size bottle into a separate container. We buy full-size retail bottles of each fragrance and decant them ourselves, by hand, using a dedicated syringe for each fragrance, into our own 5ml, 10ml or 20ml metal atomisers. Each decant carries our own label with the fragrance name.

Nothing is diluted, mixed, reformulated or altered. The fragrance in your decant is the same as in the bottle it was taken from.
Decants are repackaged by Essentra Perfumes. They are not supplied in the brand's original bottle, box or packaging, and they are not manufactured, filled, packed or sealed by the brand.
Discovery sets are combinations of individual decants put together by us.
Because decanting is done by hand, minor variations in fill level, atomiser finish or label alignment may occur. These do not affect the fragrance.

3. Authenticity and sourcing

We sell only genuine fragrances. We do not sell clones, "inspired by" formulations, imitations or first copies. Our bottles are purchased through retail and trade channels in India. Where available, we can share the batch details of the bottle your decant was filled from on request.

4. No affiliation with fragrance brands

Essentra Perfumes is an independent reseller. We are not affiliated with, authorised by, sponsored by, endorsed by or otherwise connected to any fragrance brand, manufacturer, distributor or retailer whose products appear on the Website, unless we state otherwise in writing. Nothing on the Website should be read as a claim or suggestion of any such relationship.

Because decants are repackaged by us, any warranty, guarantee or customer service offered by the brand for its original products does not apply to our decants. Any questions or claims about your order must be raised with us, not with the brand.

5. Brand names, trademarks and bottle designs

All brand names, product names, logos, trademarks, trade dress and bottle designs that appear on the Website belong to their respective owners. We use brand and product names only to identify, accurately and in good faith, the genuine fragrance that your decant is filled from. We do not claim any ownership of, or right in, any third-party brand.

6. Product images and descriptions

Images are illustrative. Product images on the Website are for illustration only. Some images are digitally created, styled or enhanced, including with the help of AI tools, to show the fragrance and its character. Props such as fruit, flowers, spices or wood are used for styling and are not part of your order.
What you receive. Where a full-size bottle is shown, it shows the original product your decant is filled from. You receive the fragrance in our own metal atomiser, in the size you select. You do not receive the full-size bottle, its box or anything else shown in the image.
Fragrance notes and descriptions. Notes, accords and scent descriptions are given as general information to help you choose. Fragrance is personal, and how a scent smells, lasts and projects depends on your skin, the weather and how much you apply. Performance figures on the Website are indicative, not a promise.
Colours and finish. On-screen colours may differ from the actual atomiser, label or packaging.

7. Our content

The Essentra Perfumes name and logo, and the text, product descriptions, photographs, graphics and page designs that we create for the Website, belong to Essentra Perfumes. You may view and share links to the Website for personal, non-commercial use. You may not copy, scrape, reproduce, republish or commercially use our content without our written permission.

8. Notices from brand owners and rights holders

We respect intellectual property rights. If you own a trademark, copyright or other right and believe that any content on the Website infringes it, please email support@essentraperfumes.in with:

your name, organisation and contact details;
the right you own and, where relevant, its registration details;
the exact page link(s) and the content you object to; and
a short explanation of why you believe the content infringes your right.

We review every notice in good faith. Where a notice is valid, we will remove or change the content concerned promptly, generally within 5 business days, and confirm the action taken to the sender.

9. Orders and acceptance

Placing an order is an offer to buy. An order is accepted only when payment, or the advance for a partial payment order, is successful and we confirm the order. We may decline or cancel an order, and refund any amount paid for it, if a product is unavailable, if there is an error in price or product information, if we suspect fraud or misuse, or if delivery is not possible to the address given.

10. Prices and payment

All prices are in Indian Rupees (INR). Shipping and any handling charges are shown at checkout before you pay. Prices and offers may change at any time, but changes do not affect orders already confirmed. If a product is listed at an incorrect price because of an obvious error, we may cancel the order and refund the amount paid. Partial payment (Cash on Delivery) orders are governed by our Partial Payment Policy. Discount codes cannot be combined unless stated and may be withdrawn at any time.

11. Cancellations

Orders can be cancelled as set out in our Refund Policy. Orders cannot be cancelled once they have been dispatched. Refusing a delivery is not a cancellation.

12. Shipping and delivery

We ship within India only. Dispatch and delivery timelines are set out in our Shipping Policy and are estimates, not guarantees. Delivery is handled by third-party courier partners, and we are not responsible for delays caused by couriers, weather, government restrictions or other events beyond our control. Please make sure your address and phone number are correct; we are not responsible for failed delivery caused by incorrect details.

13. Returns, refunds and damage claims

Because decants are opened, hand-filled products, we do not accept returns or exchanges once an order has been delivered. If your order arrives damaged, leaking, broken or incorrect, you must report it within 48 hours of delivery with a clear, continuous unboxing video starting from the sealed package, as set out in our Refund Policy. Approved claims are resolved by replacement or refund at our discretion.

14. Safe use

Perfume is for external use only and is flammable. Keep it away from heat, flames, eyes and children. Do not apply to broken or irritated skin. If you have sensitive skin or known allergies, check the listed notes and do a patch test before use, and stop using the product if irritation occurs. We cannot guarantee that a fragrance is free from any particular allergen.

15. Reviews and feedback

When you submit a review, rating, photo or other feedback, you confirm that it is honest and your own, and you allow us to display and use it on the Website and in our marketing, with your name or initials as submitted. We may remove reviews that are abusive, unlawful, off-topic or misleading.

16. Acceptable use

You agree not to use the Website for any unlawful purpose; copy or scrape its content or images; interfere with its security or operation; place fraudulent or bulk orders for resale without our agreement; or post false, defamatory or infringing content.

17. Limitation of liability

To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses, or for any loss caused by misuse of a product, failure to follow section 14, or events beyond our reasonable control. Nothing in these Terms limits any right you have under Indian consumer protection law that cannot be excluded.

18. Indemnity

You agree to indemnify Essentra Perfumes against any claim, loss or cost arising from your breach of these Terms, your misuse of the Website, or any content you submit to it.

19. Governing law and disputes

These Terms are governed by the laws of India. Subject to your rights under consumer protection law, the courts at Kanpur, Uttar Pradesh shall have exclusive jurisdiction over any dispute. We encourage you to contact us first so we can try to resolve any concern quickly.

For any complaint or grievance, please write to support@essentraperfumes.in with your order number. We acknowledge complaints within 48 hours and aim to resolve them within one month.

21. General

We may update these Terms from time to time by posting the revised version on this page; the version in force when you place an order applies to that order. If any part of these Terms is found invalid, the rest remains in effect. Our failure to enforce any part of these Terms is not a waiver of it. These Terms, together with the policies referred to above, are the entire agreement between you and us about your use of the Website. The Website is hosted on Shopify; your contract of sale is with Essentra Perfumes.
